Administrative Review Tribunal (ART) Appeals

If your visa, nomination or business approval application is refused, you may be able to lodge an appeal with the Administrative Review Tribunal (ART) to have the decision reviewed. The ART is independent from Immigration, and takes a fresh look at the entire matter.

A Tribunal Member, either on merit, or by holding a formal hearing, decides the cases. If a hearing is requested, the applicant has the opportunity put forward their case and be questioned by the Member, and witnesses can also be called to provide evidence.

If you win your appeal, the case is remitted back to the Department of Immigration. to consider again.

The ART conducts a “merits review,” meaning it examines your case afresh and is not limited to the information the Department of Home Affairs initially considered. This provides a crucial opportunity to strengthen your case and directly address the reasons for the visa refusal.
